1. INTRODUCTION

These Terms & Conditions (“Terms”) govern the supply, purchase, and use of the Comstel IPTV Box (“the Device”) and its associated 12-month individual streaming licence (“Licence”) provided by COMSTEL ICT Pty Ltd (“Comstel”, “we”, “us”, “our”).

By purchasing or using the Device, the customer (“you”, “the purchaser”) agrees to be bound by these Terms and all applicable Australian laws, including the Australian Consumer Law (ACL).


2. PAYMENT, PRICING & SUBSCRIPTION TERMS

2.1 Cost of Purchase

The total purchase price of the Comstel IPTV Box consists of:
a) The cost of the hardware (equipment) itself; and
b) A 12-month individual IPTV streaming licence included at the time of purchase.

Both components together form the initial purchase price.

2.2 Licence Duration

The included streaming licence is valid for 12 months from the date of activation or delivery (whichever occurs first).

2.3 Renewal After 12 Months

Upon expiry of the initial 12-month licence, continued access to the IPTV platform requires renewal.

  • The customer is responsible for contacting Comstel ICT prior to expiry to arrange renewal.

  • The renewal fee is $10.00 per month, billed for the following 12-month subscription period (total $120.00 per year).

  • Failure to renew will result in suspension of access to IPTV streaming services until payment is made.

2.4 No Automatic Renewal

The subscription does not automatically renew.
It is solely the customer’s responsibility to initiate renewal with Comstel ICT.

2.5 No Refunds for Licence

No refunds or partial refunds are offered for:

  • unused subscription periods,

  • change of mind,

  • internet or ISP issues,

  • customer failure to renew on time.


3. NO RETURNS & NO REFUNDS POLICY

3.1 Change of Mind
Comstel ICT does not offer refunds, returns, or exchanges for incorrect purchase, incompatibility with your internet provider, or change of mind.

3.2 Faulty or Damaged Equipment
Refunds or replacements are provided only where the hardware is confirmed faulty or damaged on arrival, in accordance with the ACL.
Faults must be reported within 7 days.

3.3 Wi-Fi Issues Are Not a Refund Basis
If the Device cannot connect via Wi-Fi due to modem configuration, signal strength, or ISP settings, this is not grounds for refund, as Ethernet cable connectivity is an available alternative.


4. INTERNET SERVICE & COMPATIBILITY REQUIREMENTS

4.1 Customer Responsibility
The customer must ensure prior to purchase that:
a) their NBN or internet service provider permits IPTV streaming, and
b) their internet speed and modem/router setup support IPTV.

4.2 No Liability for ISP Restrictions
Comstel ICT is not liable for:

  • blocked IPTV traffic,

  • ISP filtering,

  • insufficient internet speed,

  • network congestion,

  • Wi-Fi interference,

  • modem/router limitations.

4.3 Ethernet Cable Requirement
If Wi-Fi fails, the Device is required to be connected via Ethernet (LAN) cable.
This requirement does not constitute a fault and is not grounds for return.


5. SOFTWARE & LICENCE TERMS

5.1 The Device includes a 12-month individual licence for IPTV streaming.
5.2 The Licence is non-transferable and linked to the purchaser only.
5.3 Third-party content is outside Comstel ICT’s control.


6. INSTALLATION & SUPPORT

Installation and configuration are the customer’s responsibility.
Technical support is provided for general setup only and does not guarantee resolution of ISP-related issues.


7. LIMITATION OF LIABILITY

To the extent permitted under Australian law, Comstel ICT is not liable for:

  • indirect or consequential loss,

  • loss of access to content,

  • ISP performance problems,

  • customer-installed software.

Remedies are limited to hardware replacement under ACL for verified faults.


8. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia.


9. ACCEPTANCE

By purchasing or using the Comstel IPTV Box, you acknowledge and agree that:

  • the purchase price includes the hardware + 12-month licence,

  • no refunds apply except for faulty hardware,

  • internet compatibility must be confirmed by you,

  • renewal after 12 months is $10 per month and initiated by you,

  • continued access requires active subscription renewal.
